Effective date: November 26, 2025

These Terms of Service (“Terms”) govern your access to and use of triptoharam.com and the services offered by Trip To Haram (“Trip To Haram,” “we,” “us,” or “our”). By accessing or using our website or services, you agree to these Terms.

1) Who We Are

Trip To Haram is a USA‑based Islamic travel agency that assists with Umrah and Hajj arrangements, including quotations, visas, hotels, transportation, and on‑ground support with trusted partners in Saudi Arabia.

2) Eligibility and Using Our Site

  • You must be able to form a legally binding contract in your jurisdiction.
  • You agree to provide accurate, current, and complete information in enquiries and bookings.
  • If you submit information on behalf of others (for family or group travel), you represent that you have authority to share their information and make decisions for the booking.

3) Quotes, Bookings, and Payments

  • Quotes are estimates, not binding offers, and are subject to availability, supplier confirmation, and changes in price, taxes, fees, currency exchange, and schedules.
  • A booking is confirmed only after we receive the required documents and payments, and we issue a written confirmation.
  • You are responsible for all charges, fees, and taxes related to your booking and for meeting applicable payment deadlines.
  • Where applicable, additional supplier terms (airlines, hotels, ground operators, visa facilitators) apply to your booking. Those terms may include separate rules on changes, cancellations, and refunds.

4) Cancellations, Changes, and Refunds

  • Your right to cancel, change, or receive a refund is governed by the rules of the relevant suppliers and facilitators as well as our policies.
  • Many travel services are non‑refundable or partially refundable and may incur change fees.
  • If you request changes after confirmation (e.g., dates, category, travelers), additional costs may apply and availability is not guaranteed.
  • If a supplier cancels or materially changes your services, we will use reasonable efforts to assist with alternatives or refunds per the supplier’s policy.

5) Visas, Documents, and Travel Requirements

  • You are responsible for ensuring that all travelers possess the required passports, visas, permissions, vaccinations, and other documents for entry, transit, and stay.
  • We can assist with guidance and visa processing through third‑party facilitators, but issuance of visas is at the sole discretion of the authorities. We do not guarantee visa approval or processing times.
  • Any failure to meet documentation requirements or inaccuracies may lead to denial of boarding or entry at your risk and expense.

6) Role of Trip To Haram and Third‑Party Suppliers

  • We arrange services with independent suppliers, including airlines, hotels, transport providers, and on‑ground operators in Makkah and Madinah.[1]
  • Suppliers are solely responsible for the performance of their services. We are not liable for acts or omissions of suppliers or for events outside our reasonable control.

7) Itineraries and On‑Trip Support

  • Itineraries, hotels, transportation, and schedules are subject to change due to operational needs, safety, local conditions, or force majeure.
  • We provide 24/7 WhatsApp support as described on the site; response times may vary during peak periods or due to connectivity constraints.

8) Conduct and Safety

  • Travelers must comply with local laws and cultural norms, supplier rules, health and safety advisories, and any instructions from guides or authorities.
  • We may refuse service or terminate services without refund if conduct is unlawful, unsafe, or disruptive.

9) User Content and Communications

  • If you submit content to us (e.g., notes, special requests, feedback), you grant us a non‑exclusive license to use it to provide services and improve our offerings.
  • You consent to receive communications related to enquiries, quotes, bookings, and support via email, phone, and WhatsApp. You can opt out of non‑essential messages at any time.

10) Intellectual Property

  • The website, text, graphics, logos, and other materials are owned by or licensed to Trip To Haram and protected by IP laws.
  • You may not copy, modify, distribute, or create derivative works without our prior written consent.

11) Privacy

  • Our collection and use of personal information are described in our Privacy Policy. Please review it to understand how we handle data, including visa‑related documents and communications via WhatsApp and email.
  • By using our services, you acknowledge our Privacy Policy and consent to the processing of your information for service delivery.

12) Disclaimers

  • Travel involves risks. Except as required by law, services are provided “as is” and “as available.”
  • We do not guarantee uninterrupted or error‑free website access, visa approvals, exact itinerary timing, or specific outcomes, and we are not responsible for acts of third parties.

13) Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunity.
  • Our aggregate liability for any claims relating to the services will not exceed the total amounts paid to us for the specific booking giving rise to the claim.

Some jurisdictions do not allow limitations of liability; in those cases, these limitations apply to the fullest extent permitted.

14) Indemnification

You agree to indemnify and hold harmless Trip To Haram and our officers, employees, and agents from and against claims, damages, losses, and expenses (including reasonable legal fees) arising out of:

  • Your breach of these Terms
  • Your violation of laws or third‑party rights
  • Claims by travelers you book for, where you lacked authority or provided inaccurate information

15) Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including but not limited to government actions, public health events, natural disasters, strikes, conflicts, severe weather, or transportation disruptions.

16) Changes to the Terms

We may update these Terms from time to time. The Effective Date reflects the latest version. Continued use of the website or services after changes means you accept the updated Terms.

17) Governing Law and Dispute Resolution

  • Governing law: State of New York, USA, without regard to conflict‑of‑laws principles.
  • Venue: State and federal courts located in New York County, New York, shall have exclusive jurisdiction, and you consent to personal jurisdiction there.
  • Before filing suit, both parties will attempt in good faith to resolve disputes informally within 30 days after written notice.

18) Miscellaneous

  • Entire agreement: These Terms, together with your confirmation and any applicable supplier terms, form the entire agreement.
  • Severability: If any provision is unenforceable, the remainder remains in effect.
  • Assignment: You may not assign your rights without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • No waiver: Our failure to enforce a provision is not a waiver of our rights.
